3.1 Not Medical Advice

The information, content, tools, exercises, games, and AI-generated responses provided through Lumavine are for general wellness, educational, and informational purposes only. They are not intended to:

• Diagnose, treat, cure, or prevent any disease or medical condition
• Replace the advice of licensed healthcare providers
• Create a physician-patient or therapist-client relationship
• Serve as emergency mental health intervention

3.2 Consult Healthcare Professionals

Always seek the advice of your physician, mental health professional, or other qualified healthcare provider with any questions you may have regarding a medical condition, mental health concern, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read, heard, or experienced on Lumavine.

3.3 Emergency Situations

If you are experiencing a medical or mental health emergency, call your local emergency services (911 in the US) immediately. Lumavine is not equipped to handle emergencies. Crisis resources include:

3.4 Individual Results Vary

Wellness outcomes vary from person to person. We make no guarantees regarding the effectiveness of our tools, content, or features for any particular individual or purpose.

4.1 Nature of the AI

Luma Core is an artificial intelligence chatbot, not a human. By using Luma Core, you understand and acknowledge that:

• You are interacting with an AI system, not a real person
• Luma Core is not a licensed therapist, counselor, doctor, or healthcare professional
• Responses are generated by machine learning algorithms and may contain errors
• Luma Core cannot provide emergency assistance or crisis intervention
• The AI does not have memory of previous conversations unless explicitly designed to do so

4.2 Limitations of AI Responses

Luma Core's responses are provided for general wellness support and information only. The AI:

• Cannot diagnose medical or mental health conditions
• Cannot prescribe medications or treatments
• May provide inaccurate, incomplete, or outdated information
• Cannot understand context the way humans do
• Should not be relied upon for critical health decisions

4.3 Appropriate Use

Luma Core is designed for:

• General wellness conversations and check-ins
• Guided breathing and mindfulness exercises
• Motivational support and encouragement
• General information about wellness topics
• Journaling prompts and reflection exercises

Luma Core should NOT be used for: Crisis intervention, emergency situations, medical advice, diagnosis, treatment decisions, or as a replacement for professional mental health care.

4.4 Data and Privacy

Conversations with Luma Core may be logged and analyzed to improve our services. Please review our Privacy Policy for details on how your data is collected, stored, and used. Do not share sensitive personal information such as Social Security numbers, financial account details, or passwords with the chatbot.

5.1 Acceptable Use

You agree to use Lumavine only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable local, state, national, or international law or regulation
• Impersonate any person or entity, or falsely represent your affiliation
• Harass, abuse, threaten, or intimidate other users
• Post or transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to any systems or networks
• Interfere with or disrupt the Platform or servers
• Use bots, scrapers, or automated tools without authorization
• Reverse engineer, decompile, or disassemble any part of the Platform

5.2 User Content

You retain ownership of content you create on Lumavine (journal entries, posts, etc.). However, by submitting content, you grant Lumavine a non-exclusive, royalty-free, worldwide license to use, store, and process your content as necessary to provide our services.

You are solely responsible for your content and represent that it does not violate any third-party rights or applicable laws.

5.3 Community Guidelines

When interacting with other users through any community features, you agree to:

• Treat others with respect and kindness
• Not share others' personal information without consent
• Not promote harmful behaviors or content
• Report violations of these Terms to support@lumavine.ai

6.1 Wellness Games

Lumavine offers wellness-focused games designed to support relaxation, mindfulness, and mental wellness. These games are for entertainment and wellness purposes only and are not therapeutic interventions.

6.2 Points, Badges, and Rewards

Our gamification system includes points, badges, streaks, and other virtual rewards. You understand that:

• Virtual rewards have no cash value and cannot be exchanged for money
• We reserve the right to modify, reset, or remove rewards at any time
• Rewards are tied to your usage and are non-transferable
• Manipulation of the rewards system may result in access suspension

6.3 Leaderboards and Social Features

If you participate in leaderboards or social features, your username and relevant scores may be visible to other users. You can adjust your privacy settings to control what information is shared.

6.4 Health Considerations

Some games may include visual effects, animations, or audio. If you have a history of seizures, photosensitivity, or other conditions that may be affected by such content, please consult your healthcare provider before using these features and use caution.

7.1 Ownership & Creator

Lumavine, including all source code, designs, algorithms, AI system prompts, user interfaces, game mechanics, security systems, and associated intellectual property, is the sole creation and property of Brandon Wilkinson. All rights, title, and interest in the Platform are reserved.

The Lumavine name, logo, "Turn Pain Into Gain" tagline, Luma Core, SafeHaven, AI Guardian, and all associated product names, game titles, and persona names are trademarks of Brandon Wilkinson and Lumavine.

7.2 Trade Secret Protection

Lumavine contains proprietary trade secrets protected under both Canadian law and United States law, including but not limited to:

• Defend Trade Secrets Act (DTSA), 18 USC § 1836 (United States federal law)
• Criminal Code of Canada, Section 391 (up to 14 years imprisonment for trade secret theft via deceit or fraud, enacted under CUSMA)
• Canadian common law breach of confidence tort (all provinces except Quebec)
• Civil Code of Quebec contractual and civil liability protections
• Provincial trade secret protections under Alberta PIPA, BC PIPA, and PIPEDA
• Computer Fraud and Abuse Act (CFAA), 18 USC § 1030 (unauthorized access to systems)

7.3 Protected Trade Secrets

The following constitute trade secrets of Lumavine and Brandon Wilkinson. Unauthorized access, use, disclosure, reproduction, reverse engineering, or misappropriation of any of the following is strictly prohibited and will be prosecuted to the fullest extent of the law:

• AI System Prompts: 18 proprietary chatbot persona instruction sets incorporating therapeutic frameworks (CBT, DBT, motivational interviewing, trauma-informed care), crisis response protocols, and behavioral design patterns
• Multi-Language Crisis Detection Algorithm: Real-time suicidal ideation and crisis keyword detection across 10+ languages (English, French, Spanish, Arabic, German, Portuguese, Italian, Chinese, Japanese, Korean) with localized emergency resources per region
• Persona Switching with Conversation Continuity: Proprietary method for maintaining conversational context when users switch between AI personas within a single session, using sliding-window history management and context injection
• AI Guardian Behavioral Biometrics: Zero-knowledge security system using encrypted behavioral fingerprinting (keystroke dynamics, mouse movement, navigation timing), AES-256-GCM encryption, anomaly scoring, and adaptive baseline retraining
• Therapeutic Game-AI Integration: Bidirectional data flow between wellness games and AI chatbot personas, where game performance informs AI recommendations and AI conversations guide game selection
• SafeHaven Crisis Widget: Embeddable worldwide crisis intervention widget with real-time weather-based exposure risk assessment, shelter locator, SOS contacts, and AI-assisted crisis support
• Platform Correlation Engine: Cross-platform wellness pattern detection that synthesizes data from chatbot interactions, game performance, wellness check-ins, and journal entries

7.4 First-of-Its-Kind Innovations

Brandon Wilkinson and Lumavine are the first creators of the following integrated features in a unified wellness platform:

• 18 Specialized AI Wellness Personas: The first platform to deploy 18 distinct AI chatbot personas each specialized in a different wellness domain (mental health, addiction recovery, trauma support, fitness, nutrition, sleep, career, parenting, elder care, financial wellness, cognitive training, life transitions, mood enhancement, activity tracking, daily planning, goal setting, community support, and unified wellness coordination) — where competitors typically offer 1-3 generic assistants

7.5 Prohibited Activities

You agree that you will NOT, under any circumstances:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or system prompts of any Lumavine technology
• Attempt to extract, reconstruct, or replicate AI system prompts through prompt injection, conversation manipulation, or any other technique
• Scrape, crawl, or use automated tools to collect data, content, or intellectual property from the Platform
• Copy, reproduce, modify, distribute, or create derivative works based on Lumavine's proprietary technology, designs, game mechanics, or features
• Use any Lumavine trade secrets, proprietary information, or intellectual property to develop competing products or services
• Circumvent, disable, or interfere with any security features, including the AI Guardian system
• Access or attempt to access any systems, data, or source code beyond what is made available through the normal operation of the Platform

7.6 Enforcement & Remedies

Violation of this section may result in:

• Immediate termination of your access to Lumavine
• Civil action for trade secret misappropriation, including injunctive relief and monetary damages under the DTSA and Canadian common law
• Criminal prosecution under Criminal Code of Canada Section 391 (up to 14 years imprisonment) and/or the CFAA (18 USC § 1030)
• Recovery of all profits derived from misappropriation, plus exemplary damages where applicable
• Recovery of reasonable attorney's fees and costs of litigation

Brandon Wilkinson and Lumavine reserve the right to pursue all available legal remedies in any jurisdiction where infringement or misappropriation occurs, including but not limited to Canada, the United States, and internationally under applicable treaties.

7.7 Free Platform

Lumavine is completely free for all users. There are no subscription plans, premium tiers, or payment requirements. All features, including all 18 AI chatbot personas, all wellness games, data export, theme customization, and full wellness tracking, are available to every user at no cost.

8.1 Disclaimer of Warranties

LUMAVINE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any content
• Warranties regarding the results from using the Platform

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE LAWS OF CANADA AND THE PROVINCE OF ONTARIO, LUMAVINE, ITS FOUNDER, AND ITS DEVELOPER (SOLTOLARIA STRATEGIC SOLUTIONS) SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages arising from your use or inability to use the Platform
• Any damages related to AI-generated content, responses, or recommendations
• Any damages arising from third-party actions or content

8.3 AI Chatbot Disclaimer & User Responsibility

ALL AI CHATBOT RESPONSES ON LUMAVINE ARE GENERATED BY ARTIFICIAL INTELLIGENCE AND ARE PROVIDED FOR INFORMATIONAL AND WELLNESS SUPPORT PURPOSES ONLY. Lumavine, its founder, and Soltolaria Strategic Solutions are not responsible or liable for any actions, decisions, or outcomes resulting from a user's reliance on AI-generated content. Specifically:

• AI responses do not constitute professional medical, legal, financial, or psychological advice
• Users are solely responsible for any decisions or actions they take based on AI chatbot responses
• Lumavine makes no guarantees regarding the accuracy, completeness, or suitability of AI-generated content
• Users should always consult qualified professionals before making health, legal, or financial decisions
• Lumavine shall not be held liable for any harm, injury, loss, or damage of any kind arising from a user's interpretation of or reliance on AI chatbot output
• By using the AI chatbot features, you acknowledge and accept these limitations and assume full responsibility for how you use the information provided

8.4 Cap on Liability

Lumavine is a completely free platform. In no event shall total liability to you exceed one hundred Canadian dollars (CAD $100).

8.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

9.1 Your Right to Stop Using Lumavine

You may stop using Lumavine at any time. If you wish to have any locally stored data removed, you can clear your browser data or contact support@lumavine.ai for assistance.

9.2 Our Right to Terminate

We reserve the right to suspend or terminate your access at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Conduct that harms other users or the Platform
• Misuse of platform resources
• Extended periods of inactivity
• At our sole discretion for any other reason

9.3 Effect of Termination

Upon termination:

• Your right to use Lumavine immediately ceases
• We may delete any data associated with your usage (subject to legal retention requirements)
• Any virtual rewards, points, or progress will be forfeited
• Provisions that by their nature should survive will survive termination

10.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@lumavine.ai to attempt to resolve any dispute informally. We will attempt to resolve disputes within 30 days.

10.2 Binding Arbitration

PLEASE READ CAREFULLY: You and Lumavine agree that any dispute, claim, or controversy arising from or related to these Terms or the Platform shall be resolved through binding arbitration, rather than in court, except that either party may seek equitable relief in court for infringement of intellectual property rights.

Arbitration shall be conducted by a neutral arbitrator in accordance with the ADR Institute of Canada rules. The arbitration shall take place in the Province of Ontario, Canada, or may be conducted remotely.

10.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH LUMAVINE ON AN INDIVIDUAL BASIS ONLY. You waive the right to participate in any class action, collective action, or representative proceeding against Lumavine. This waiver applies to both arbitration and court proceedings.

10.4 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Additionally, this arbitration agreement does not preclude you from filing complaints with government agencies.

10.5 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. For matters relating to intellectual property and trade secret protection, the laws of Canada (including Criminal Code Section 391, PIPEDA, and provincial trade secret law) shall apply. Where Lumavine has users in the United States, applicable US laws (including the DTSA, CFAA, and applicable state law) shall also apply to the fullest extent permitted.

10.6 Time Limitation

Any claim or cause of action arising from or related to these Terms or the Platform must be filed within one (1) year after the claim arose, or it shall be forever barred.

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Lumavine regarding your use of the Platform.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

11.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

11.5 Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use after changes are posted constitutes acceptance of the modified Terms.
